We are Eatz On Demand LLC (“Company,” “we,” “us.” “our”), a company registered in Connecticut, United States. We operate the website http://www.eatzod.com (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services ).

We provide delivery from third party restaurants to your store front.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Eatz On Demand LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. 

1.0. Liability  

Eatz On Demand is a delivery service. Eatz On Demand assumes no liability for any issues with the prepared food. All issues with prepared food must be directly handled through the restaurant or third party ordering service. Eatz On Demand assumes no liability for payment errors for prepared food orders through third party food ordering sites. 

2.0 Return Policy 

Delivery orders placed with Eatz On Demand are final. In the case something is missing from your order due to delivery, or delivery exceeds ten minutes. Eatz On Demand will offer a free delivery at our discretion as customer appeasement. Food orders made through eatzod.com are final, in the case something is missing or incorrect from your food order, the restaurant will extend 15% off at their discretion. Inquiries for order issues must be submitted with order number within 24 hours of order on eatzod.com for consideration. 

3.0 Disclaimer

You agree that Eatz On Demand is not responsible for food preparation, food handling, or the safety of the food. Eatz On Demand assumes no liability for food safety for prepared food. Any complaints or claims regarding the food service, quality, or adverse effects of consumption are subject to the third party food ordering site. You agree that you are responsible for knowledge of any allergens before placing a delivery request.

4.0 Communication with Eatz On Demand 

By requesting delivery through Eatz On Demand you accept and receive communications on behalf of Eatz On Demand via email, text message, and calls, to the contact information you provide to Eatz On Demand when you place a delivery request on eatzod.com. Further, you understand and agree that you may receive communications sent by or on behalf of Eatz On Demand including but not limited to communications concerning orders (messages to confirm requested, questions about request updates on delivery and confirmation of delivery) you place through earzod.com. Message and data rates may apply and message frequency may vary. The communications in this section may include, without limitation, commercial or marketing messages, transactional or relationship messages (e.g., messages about the availability of our services (e.g., interruptions in service), updates to policies/legal agreements (e.g., privacy policies, terms of service)), or customer support (those initiated by you and by us). You acknowledge that receiving commercial or marketing messages or calls is a requirement or condition for you to use the Services. 

5.0 Electronic Records

By creating a delivery request with Eatz On Demand you consent to the use of electronic records. You also agree that all terms and conditions, agreements, notices, disclosures, and other communications that Eatz On Demand provides to you electronically satisfy any legal requirement for such communications to be in writing. You agree to provide current contact information, including email address. This paragraph does not affect your statutory rights.

To view and retain a copy of this Agreement, you will need (a) a device (such as a computer or mobile phone) with a web browser and Internet access, and (b) either a printer or storage space on such device.

6.0 Internet Delays

Technology and Services may be subject to limitations, delays, and other problems inherent in the use of the Internet and electronic communications. Except as otherwise required by applicable law and subject to the Non-Excusable Provisions, Eatz On Demand is not responsible for any delays, delivery failures, damage, loss, injury, or other economic damage resulting from such problems.

7.0 Intellectual Property Ownership

Eatz On Demand alone (and its licensors, where applicable) shall own all right, title, and interest, including all related intellectual property rights, in and to the Technology and the Services. This Agreement is not a sale and does not convey to you any rights of ownership in or related to the Technology or the Services, or any intellectual property rights owned by Eatz On Demand. Eatz On Demand names, Eatz On Demand logos, and the product names associated with the Technology and Services are trademarks of Eatz On Demand or third parties, and no right or license is granted to use them. You agree that you will not remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Technology or the Services.
